Blush Wellness Program Terms & Conditions

Thank you for your interest in The Blush Wellness program at participating Blush Lane Organic Market stores (“Participating Stores”).

Your membership will be governed by these terms – they will be between you, as the member, and Blush Lane Organic Produce Ltd.

The Blush Lane Organic Market Privacy Policy governs how we will treat your information. There may be other applicable terms, conditions, limitations and requirements depending on where you are located and what you are purchasing. Finally, there may be applicable terms related to any promotional offers provided to you for use with The Blush Wellness membership. When you purchase or use your Blush Wellness discount, you accept this relationship and these terms. We may make changes at any time, at our discretion and without notice, to these Terms or we may terminate The Blush Wellness Club. If we make material changes or terminate The Blush Wellness Club, we will notify you by email and/or post the new terms at Blushlane.com/Blushwellnessclub

As a member of The Blush Wellness program, upon your purchase and activation of your membership for $30, you will receive 15% off regular priced eligible purchases. Your Blush Wellness membership will expire in one year, ending on the one year anniversary from which you purchased your membership. 

Eligible purchases are:

• Nutritional Supplements
• Homeopathy
• Protein powders and herbal powders
• Body care
• Cosmetics

The discount is based upon the posted price for the item.  No other discounts or promotions will be combined with this offer. You must present both your phone number on file as well as your ID at the point of sale to receive your discount for that sale.

The Blush Wellness card discount does not apply to nutrition bars, herbal teas, housewares or lifestyle products such as clothing, books, cards and magazines. Purchases made prior to joining the program, purchases made for resale, purchases on-line, and charges or taxes on purchases do not qualify to receive the discount. Purchases made with a gift card are eligible for benefits. Other exclusions may apply.

Your Blush Wellness membership discount must be applied at the point of sale, you may not bring back your receipt at a later date and request the application of your benefits.

Your membership and benefits are exclusive to you. They are not transferable and may only be used by you.

The Blush Wellness Club is currently offered at all Blush Lane Organic Market locations in Alberta. You can sign up at all participating stores. Participating stores are subject to change or terminate the club at anytime. 

The Blush Wellness program participation is available to all qualifying individuals 18 years of age and over.

You must provide and maintain a valid e-mail address and promptly update your account with any changes. You acknowledge that Blush Lane Organic Market will communicate with you about program changes and promotional materials through this e-mail address. By signing up for The Blush Wellness program, you are agreeing to receive promotion emails from Blush Lane Organic Market. You may opt out of promotional emails at any time. 

You may not transfer or assign your issued Blush Wellness membership or benefits. Additional restrictions may apply to Blush Lane Organic Market team members. Your membership and benefits are exclusive to you. They are not transferable and may only be used by you.

You may cancel your membership of the Blush Wellness Club within the first 14 days for a full refund of your membership fee minus the discount amount that was applied to any purchases made with your Blush Wellness Club discount. Please talk to customer service in order to receive a refund. Refunds may take up to 2 business days.

We reserve the right to terminate your issued Blush Wellness membership because of conduct that we determine, in our discretion, violates these Terms or any applicable law, involves fraud or misuse of your Blush Wellness membership or benefits, or is harmful to our interests or another customer. We also reserve the right to deny future membership if we deem your conduct to violate these Terms. Our failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights.

We reserve the right to terminate or continue the Blush Wellness program at any time. In the event we terminate the Blush Wellness program prior to the expiration of your issued Blush Wellness card, you may request a pro-rata refund from a participating location of the amount paid for your issued Blush Wellness membership for up to three (3) months after the effective date of such termination. The pro-rata amount will be based upon the period for which you were a member. If the Blush Wellness program is still in effect at the time your Blush Wellness card expires and you wish to continue as a member of the program, you must pay an annual renewal fee.

We pride ourselves in our customer service, your local store will be able to assist you with any questions or assistance needed with your Blush Wellness program.

We may, in our discretion and at any time, change these Terms, Blush Lane Organic Market Privacy Policy and Terms or any aspect of the Blush Wellness program. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. Your continued membership after we change these terms constitutes your acceptance of the changes. If you do not agree to any changes, you must cancel your membership.

The Blush Wellness program and the content, logos, taglines, and trademarks are the intellectual property of Blush Lane Organic Produce Ltd. and licensed under controlled conditions. The Blush Wellness program terms are void where and to the extent prohibited by law. Taxes may apply where required by law.

In addition to other limitations and exclusions in blushlane.Com terms of use and to the extent not prohibited by applicable law, under no circumstances will we or our directors, officers, employees, agents or other representatives or any blush lane organic market parties be liable for any direct, indirect, special, incidental, consequential, or punitive damages, or any other damages of any kind, arising out of or related to the program. Our total liability, whether in contract, warranty, tort (including negligence) or otherwise, will not exceed the total amount you spent on qualifying purchases in the most recent twelve-month period. These exclusions and limitations of liability will apply to the fullest extent permitted by law and will survive cancellation or termination of your membership. Applicable law may not allow the limitation of liability set forth above, so this limitation of liability may not apply to you, and you may have rights additional to those contained herein.

This is a comprehensive limitation of liability that applies to all losses and damages of any kind (including personal injury or death or for any direct, indirect, economic, general, special, punitive, incidental, exemplary or consequential damages of any kind, including without limitation, loss of data, income, or profits, in connection with, or otherwise directly or indirectly related to, without limitation, the program or other blush lane organic market products or services, even if blush lane organic market has been advised of or should have known of the possibility of such damages regardless of whether you bring an action based in contract, negligence, strict liability, or tort (including whether caused, in whole or in part, by negligence, acts of god, telecommunications failure, or destruction of the service). Each provision of these terms & conditions that provides for a limitation of liability, disclaimer of warranties, or exclusion of damages is to allocate the risks under the agreement between you and blush lane organic market. This allocation is an essential element of the basis of the bargain between you and blush lane organic market. The limitations in this section will apply even if any limited remedy fails of its essential purpose(s). If you are dissatisfied with the program or these terms & conditions, your sole and exclusive remedy is to terminate your membership. You acknowledge, by your participation in the program, that your participation in the program is at your sole risk.

Notwithstanding the foregoing, this section does not expand or limit (I) any express, written product warranty or related disclaimers that are provided by blush lane organic market parties or their suppliers with regard to a physical product sold by blush lane organic market parties to you, or any warranty on a physical product to the extent required by applicable law; (ii) blush lane organic market parties’ liability for personal injury to you caused by blush lane organic market parties to the extent not waivable under applicable law; or (iii) any cause of action you may have against blush lane organic market parties that is not waivable under applicable law.

To the fullest extent not prohibited by applicable law, if you claim that you have incurred any loss, damages, or injuries in connection with your use of the service, then the losses, damages, and injuries will not be deemed irreparable or sufficient to entitle you to an injunction or to other equitable relief of any kind. This means that, in connection with your claim, you agree that you will not seek, and that you will not be permitted to obtain, any court or other action that may interfere with or prevent the development or exploitation of any website, application, content, user-generated content, product, service, or intellectual property owned, licensed, used or controlled by blush lane organic markets or a licensor of blush lane organic market.

Resellers are excluded from the program and from receiving the discount. If we mistakenly issue membership to a reseller, we reserve the right to terminate such membership and issue a pro-rata refund of the membership fee.
